By downloading, installing, or using the Aurora AI mobile application (“App”) or any related services (collectively, “Services”) provided by AURORAX INC (“Aurora AI”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use our Services.
2. Description of Service
Aurora AI is an AI-powered search platform that helps users find products, services, pricing, and availability from real-world businesses in real time. Aurora contacts businesses on your behalf and aggregates results based on your queries.
3. Eligibility
You must be at least 13 years old to use our Services. By using the App, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms.
4. User Accounts
You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and complete registration information
- Keep your password secure and not share it with others
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
5. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Services for any unlawful, fraudulent, or abusive purpose
- Submit false, misleading, or deceptive queries
- Attempt to reverse-engineer, scrape, or extract data from the App
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Interfere with or disrupt the integrity or performance of the Services
- Use the Services to send unsolicited communications to businesses
6. AI-Generated Results
Aurora AI uses artificial intelligence to contact businesses and compile results. While we strive for accuracy, we do not guarantee that results are complete, current, or error-free. You acknowledge that:
- Prices, availability, and business information may change after Aurora contacts a vendor
- Aurora does not endorse any business or vendor returned in search results
- You are responsible for independently verifying any information before making a purchase or commitment
- Aurora is not a party to any transaction between you and a vendor
7. Intellectual Property
All content, software, designs, trademarks, and technology in the App are owned by or licensed to AURORAX INC. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or create derivative works from any part of the Services.
8. Privacy
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of your information as described in our Privacy Policy.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, AURORA AI DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AURORAX INC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In no event shall our total liability to you exceed the amounts you have paid to us in the twelve (12) months prior to the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless AURORAX INC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Services, your violation of these Terms, or your violation of any rights of another party.
12. Termination
We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Services will immediately cease.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms in the App or by sending you a notification. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
